Cada dos años, el consejo superior de la administración elegirá, también en forma paritaria doce (12) consejos del tribunal superior disciplinario, quienes remplazaran a los magistrados del mismo en los casos de impedimento o de recusación, y dirimirán los empates que se presenten en las votaciones sobre providencias que deban ser adoptadas en sala plural. En cada negocio, los jueces seran escogidos por sorteo que hará por la sala de gobierno del tribunal. Dicho sorteo se circunscribirá a los conjueces que tengan la misma filiación política del magistrado o magistrados impedidos o recusados.
