Cuando la cosa reivindicada o recuperada sea raíz, tendrá el Gobierno poción para ordenar la licitación del inmueble, de acuerdo con las prescripciones del artículo 13 del Código Fiscal, o incluir en la Ley de Apropiaciones la partida respectiva para pagar al contratista en dinero la participación que le corresponda.
