Si las sentencia dictada en el juicio a que se refiere el artículo 4° es favorable al denunciante, se procederá dentro de los cinco días siguientes a la llegada del expediente al Ministerio, a conferirle la personería por medio de poder extendido en instrumento público en que se tendrán en cuenta las prescripciones legales y las estipulaciones del contrato celebrado con el denunciante favorecido por el fallo, y las demás circunstancias que en éste se determinen.
