°. Incoada la demanda está obligado el contratista a llevar el juicio hasta su terminación, dentro de los términos legales y un año más; en este caso no le serán imputables sino las demoras que provengan de su omisión o culpa, pero si abandonare el juicio por tres meses continuos, se declarará caducado administrativamente el contrato, y el Gobierno por medio de sus agentes, continuará el juicio en el estado en que quedó, sin que el contratista tenga derecho a la participación estipulada.
