Articulo 5 º SUSTITUCIÓN PENSIONAL. Hay sustitución pensional en los siguientes casos

Cuando fallece una persona pensionada o con derecho a pensión de jubilación, invalidez o vejez;

Cuando fallece un trabajador particular o un empleado o trabajador del sector público después de haber completado el tiempo de servicios requerido por la ley, convenciones o pactos colectivos para adquirir el derecho a la pensión de jubilación.
