De la determinación de los intereses moratorios. Para determinar el valor histórico actualizado a que se refiere el artículo 4°, numeral 8° de la Ley 80 de 1993, se aplicará a la suma debida por cada año de mora el incremento del índice de precios al consumidor entre el 1° de enero y el 31 de diciembre del año anterior. En el evento de que no haya transcurrido un año completo o se trate de fracciones de año, la actualización se hará en proporción a los días transcurridos.
