Se entiende que falta el cónyuge o compañero (a) permanente y por lo tanto se pierde el derecho a la pensión de sobrevivientes o a la sustitución de la asignación de retiro o de la pensión de invalidez, en cualquiera de las siguientes circunstancias, según el caso: 12.1 Muerte real o presunta. 12.2 Nulidad del matrimonio. 12.3 Divorcio o disolución de la sociedad de hecho. 12.4 Separación legal de cuerpos. 12.5 Cuando lleven cinco (5) o más años de separación de hecho.
