Vencido el término probatorio, o si no ha habido oposición, el Juez falla dentro de los seis días siguientes. Si se decreta la restitución, ésta debe hacerse al día siguiente al de la ejecutoria del auto, o a más tardar en el subsiguiente, salvo fuerza mayor.
En el caso de resistencia, el Juez hace uso de la fuerza para imponer su decisión.
