El Artículo 248 Del Código Civil Quedará Así:

Ley 1060 de 2006 · por la cual se modifican las normas que regulan la impugnación de la paternidad y la maternidad.

amends ley 84/73

Artículo 248 . En los demás casos podrá impugnarse la paternidad probando alguna de las causas siguientes:

Que el hijo no ha podido tener por padre al que pasa por tal.

Que el hijo no ha tenido por madre a la que pasa por tal, sujetándose esta alegación a lo dispuesto en el título 18 de la maternidad disputada.

No serán oídos contra la paternidad sino los que prueben un interés actual en ello, y los ascendientes de quienes se creen con derechos, durante los 140 días desde que tuvieron conocimiento de la paternidad.
