Derechos Definitivos. Cuando se hubiere establecido un derecho compensatorio definitivo, ese derecho se percibirá en las cuantías señaladas en la resolución que lo fije, sobre las importaciones de ese producto respecto de las cuales se haya concluido que se efectúan con subvención y que causan daño a una rama de producción en Colombia.

La Dirección de Comercio Exterior, previa recomendación del Comité de Prácticas Comerciales, adoptará la decisión más conveniente para los intereses del país y podrá determinar que el derecho compensatorio sea igual o inferior a la cuantía total de la subvención, para efectos de eliminar el daño.
