Para asegurar el cumplimiento del convenio previsto en el numeral 2 del artículo 111 de la Ley 489 de 1998 y los principios constitucionales y legales que inspiran el ejercicio de la función administrativa a que se refiere este decreto, la persona natural o jurídica privada seleccionada deberá constituir a favor de la Nación - Ministerio de Comercio, Industria y Turismo, las garantías destinadas a amparar los perjuicios de naturaleza contractual o extracontractual que se establezcan en los pliegos de condiciones.
