º. Si el destinatario no recibe la mercancía dentro del término establecido por el artículo anterior, habiéndose dado eI correspondiente aviso en forma oportuna, la empresa transportadora autorizada, pagará al propietario o poseedor del vehículo que realizó el transporte una suma igual a tres (3) salarios mínimos legales diarios vigentes, por cada hora de retardo. La empresa transportadora podrá repetir contra el destinatario.
