Se sucede abintestato, ya por derecho personal, ya por derecho de representacion.

La representacion es una ficcion legal en que se supone que una persona tiene el lugar i por consiguiente el grado de parentesco i los derechos hereditarios que tendria su padre o madre si ésta o aquel no quisiese o no pudiese suceder.

Se puede representar a un padre o una madre que, si hubiese podido o querido suceder, habria sucedido por derecho de representacion.
