Solo podrá solicitar la declaración de nulidad el sujeto procesal que resulte perjudicado por la concurrencia de la causal, siempre y cuando no hubiere contribuido a causarlo. También podrán solicitarla el Ministerio Público y el Ministerio de Justicia y del Derecho. La persona que alegue una nulidad deberá probar la causal que invoca, las razones en que se funda y no podrá formular una nueva, sino por causal diferente o por hechos posteriores.
