Lo dispuesto en el artículo precedente se aplica no sólo a las obras nuevas, sino a las ya hechas, mientras no haya transcurrido tiempo bastante para constituir un derecho de servidumbre.

Pero ninguna prescripción se admitirá contra las obras que corrompan el aire i lo hagan conocidamente dañoso.
