Art. 3º. Si la Gobernación del Tolima hiciere uso de la autorización que le confiere la ordenanza número 24 del presente año, el contrato de que trata esta ley se hará de común acuerdo entre el Gobierno y dicha Gobernación; y en este caso, tal contrato puede hacerse sin necesidad de licitación, dejando a juicio de los mencionados Gobierno y Gobernación la adjudicación del contrato á la persona ó compañía que ofreciere mayores ventajas, ó que, en igualdad de condiciones, dé mayores garantías de cumplimiento.
