ART 221. En el delito de ASESINATO definido en el artículo 440 del Código, constituyen grado máximo de gravedad cada una de las siete circunstancias allí enumeradas, excepto la última.

En caso de asesinato, cometido con esta sola circunstancia agravante, además de la de premeditación, el asesino sufrirá la pena mayor de las señaladas al homicidio premeditado.
