Procedimiento para la declaratoria del empleo por abandono del cargo. Con sujeción al procedimiento administrativo regulado por el Código de Procedimiento Administrativo y de lo Contencioso Administrativo y demás normas que la modifiquen, adicionen o sustituyan, el jefe del organismo deberá establecer la ocurrencia o no de cualquiera de las conductas señaladas en el artículo anterior y las decisiones consecuentes.

Parágrafo

Si por el abandono del cargo se perjudicare el servicio, el empleado se hará acreedor a las sanciones disciplinarias, fiscales, civiles y penales que correspondan.
