Artículo cincuenta y cinco. En materia penal hay lugar a interponer el recurso de casación: 1º. Contra las sentencias dictadas en segunda instancia por los Tribunales Superiores de Distrito Judicial, en causas cuyo conocimiento haya correspondido a los Jueces Superiores. 2º. Contra las sentencias dictadas en segunda instancia por los Tribunales de Distrito Judicial en causas de que hayan conocido los Jueces Municipales por delitos que tengan señalada sanción privativa de la libertad cuyo máximo sea o exceda de cinco años, y 3º. Contra las sentencias dictadas en única instancia por los Tribunales Superiores de Distrito Judicial.
