Art. 5. El Prefecto, ó el Alcalde, ó en su caso, cuando se trate de los delitos a que se refiere está Ley, procederá de oficio ó por denuncio á averiguar en forma sumaria dentro de tres días, la existencia del cuerpo del delito y de la culpabilidad de los delincuentes.
