Respecto de las mercancías que se encuentran bajo custodia del Fondo Rotatorio de Aduanas, al primero (1) de septiembre de 1990, cuando respecto de las mismas no se haya definido su situación jurídica y no exista proceso administrativo, éste podrá enajenarlas, destruirlas o asignarlas.
