º. La expropiación de la zona que requiera el camino se hará por los tramites señalados en el capitulo IX del código Judicial, siempre que no sea posible por medio de mutuo acuerdo arreglar entre el gobierno y el propietario el traslado del dominio. En tal virtud, antes de promover el juicio, se avisara al interesado la necesidad que se tiene de tomar la porción de terreno que se haya determinado y deslindado, a fin de recavar si conviene cederla gratuitamente ó por un precio razonable.
