El Fiscal del Tribunal o el Personero Municipal están en la obligación de investigar los casos que denuncien los Administradores de Aduana, y si encontraren fundamento de que se ha violado la ley o que hay lugar a multa, secuestro o embargo por razón de tal violación, establecerán inmediatamente la acción correspondiente ante el Tribunal Distrital de Aduanas para que se imponga la multa y se decomise la mercancía, el equipaje, la nave o el vehículo, según fuere el caso.
