A. Intervención del ICBF . En todos los casos en que la víctima sea un menor de edad, que carezca de representante legal o que teniéndolo, incumpliere sus obligaciones o careciere de las condiciones económicas necesarias o de las calidades morales o mentales, para asegurar la correcta formación del menor de edad, el funcionario que conozca de la investigación dará aviso al Instituto Colombiano de Bienestar Familiar, para que el defensor de familia competente, adopte las medidas de protección que el caso amerite, e intervenga y promueva las acciones judiciales necesarias, en representación del menor y la familia.
