º Al responsable de alguna de las conductas punibles previstas en el Código Penal, Cuando su acción aparezca encaminada a perseguir o intimidar a cualquier habitante del territorio nacional por sus creencias u opiniones políticas, partidistas o no, se le aplicará, la pena prevista en la respectiva disposición aumentada de una cuarta parte a la mitad. La misma pena se impondrá si la conducta se realiza contra los parientes, hasta el cuarto grado de consanguinidad, segundo de afinidad o primero civil, de la persona a quien se pretende intimidar o perseguir por razón de sus creencias u opiniones políticas.
