Art. 1512. El error acerca de la persona con quien se tiene intención de contratar, no vicia el consentimiento, salvo que la consideración de esta persona sea la causa principal del contrato.

Pero en este caso la persona con quien erradamente se ha contratado tendrá derecho a ser indemnizada de los perjuicios en que de buena fe haya incurrido por la nulidad del contrato.
