El Fiscal Penal Militar encargado de la dirección de la investigación, según lo establecido en los artículos siguientes y con el fin de obtener elementos materiales probatorios y evidencia física o realizar la captura del indiciado, acusado o condenado, solicitará al Juez Penal Militar de control de garantías el registro y allanamiento de un inmueble, nave o aeronave, el cual será realizado por la policía judicial. Si el registro y allanamiento tiene como finalidad única la captura del indiciado, imputado, acusado o condenado, sólo podrá ordenarse en relación con delitos susceptibles de medida de aseguramiento de detención preventiva.
