El Gobierno puede conceder licencias a los Magistrados del Tribunal Supremo para separarse de sus destinos hasta por noventa días en un año.
En este caso llamará el suplente respectivo, y la agotada la lista lo comunicará a la Corte suprema de Justicia para que nombre el Magistrado interino teniendo en cuenta lo dispuesto en el artículo.
