Las empresas de operación portuaria no requieren licencia o permiso especial de las autoridades portuarias o marítimas para organizarse y cumplir su objeto; pero si se constituyen como sociedad deben someterse a los requisitos del Decreto 410 de 1971 (Código de Comercio).
