Cuando el asegurado y el beneficiario mueren simultáneamente o se ignora cuál de los dos ha muerto primero, tendrán derecho al seguro el cónyuge y los herederos del asegurado, en las proporciones indicadas en el artículo anterior, si el título de beneficiario es gratuito; si es oneroso, los herederos del beneficiario.
