El Consejo de Estado elegirá un cuerpo de conjueces del Consejo Nacional Electoral igual al doble de sus miembros en forma que refleje la composición política de éste. Cuando se presenten empates, impedimentos o recusaciones aceptados por el Consejo Nacional, o cuando no haya decisión, éste sorteará conjueces. En casos de impedimentos o recusaciones el Conjuez será de la misma filiación política del Consejero separado. (Modificado según Artículo 8 Ley 96 de 1985 .)
