Cuando se presente vacancia en un cargo y se hallen en carrera y ocupen notarias de la misma comisaría tendrán derecho a pedir que se les traslade al cargo vacante, siempre que se traten del mismo Departamento. Sí la solicitudes en ese sentido fueren varias, la nominadora decidirá teniendo en cuenta la mayor puntuación obtenida en el concurso de ingreso y, en caso de empate, el tiempo de servicio.
