La ley penal colombiana se aplica a todos los habitantes del territorio nacional que la infrinjan, salvo las excepciones reconocidas por el Derecho Internacional.
Se considera cometido en Colombia el delito que se principia a ejecutar en el Exterior y se consume o frustre en el territorio nacional.
