º. En el trámite de reconstrucción de procesos intervendrá el respectivo agente del Ministerio Público, de conformidad con las normas sobre la materia. En aquellos casos en que no existiere parte interesada o en los que existiendo, no solicite la reconstrucción, y éste sea pertinente, el Ministerio Público hará la solicitud de reconstrucción y aportará las pruebas que obren en su poder.
