CONSECUENCIA DE LA PROVIDENCIA DEFINITIVA. Cuando en un proceso penal de los mencionados en el artículo anterior se profiera sentencia condenatoria, se dispondrá el retiro del servicio del responsable. Pero si hubiere absolución o cesación de procedimiento por causa diferente de la prescripción de la acción penal y la providencia quedare en firme, el Jefe del Departamento, si lo estima conveniente, dispondrá su reintegro al cargo.
