Art. 747. El error en el título invalida la tradición, sea cuando una sola de las partes supone un título traslaticio de dominio, como cuando por una parte se tiene el ánimo de entregar a título de comodato, i por otra se tiene el ánimo de recibir a título de donación, o sea cuando por las dos partes se suponen títulos traslaticios de dominio, pero diferentes, como si por una parte se supone mutuo i por otra donación.
