El notario no permitirá el otorgamiento del instrumento cuando no se le compruebe la definición de la situación militar por los comparecientes que de acuerdo con normas legales deban cumplir este requisito, salvo en lo relacionado exclusivamente con el estado civil. Cuando se actúe por poder, tal circunstancia debe constar en él certificada por quien lo autentique, a menos que se acredite en el momento de suscribir la escritura.
