La colisión puede ser provocada de oficio o a solicitud de parte. Quien la suscite se dirigirá al otro juez o fiscal, exponiendo los motivos que tiene para conocer o no. Si éste acepta, asumirá el conocimiento; en caso contrario, enviará el proceso al Tribunal Superior Militar, o al fiscal ante esta Corporación o a la Sala Disciplinaria del Consejo Superior de la Judicatura, para que allí se decida de plano, según el caso.
