- INCAPACIDAD FISICA PERMANENTE. En caso de que por motivos de salud debidamente certificado por la entidad de previsión social a la que estén afiliados los funcionarios de la alcaldía respectiva, un Alcalde se vea impedido definitivamente para continuar desempeñándose como tal, el Presidente de la República, en el caso del Distrito Capital de Santafé de Bogotá, y los Gobernadores, en los demás casos, declararán la vacancia por falta absoluta (Ley 136 de 1994, art. 101).
