- EXCEPCION. Las creaciones de municipios aprobadas por las Asambleas Departamentales antes del 31 de Diciembre de 1990, son válidas de acuerdo con el artículo 40 transitorio de la Constitución Política. Igualmente, las creaciones de municipios aprobadas por las Asambleas Departamentales, entre el 31 de Diciembre de 1990 y el Lo. de Diciembre de 1993, son válidas siempre y cuando no se haya decretado su nulidad por los tribunales competentes, mediante sentencia ejecutoriada (Ley 136 de 1994, art. 11).
