El médico quedará exonerado de hacer la advertencia del riesgo previsto en los siguientes casos

Cuando el estado mental del paciente y la ausencia de parientes o allegados se lo impidan;

Cuando exista urgencia o emergencia para llevar a cabo el tratamiento o procedimiento médico.
