El contrato de concesión y los demás títulos emanados del Estado de que trata el artículo anterior, no transfieren al beneficiario un derecho de propiedad de los minerales "in situ" sino el de establecer, en forma exclusiva y temporal dentro del área otorgada, la existencia de minerales en cantidad y calidad aprovechables, a apropiárselos mediante su extracción o captación y a gravar los predios de terceros con las servidumbres necesarias para el ejercicio eficiente de dichas actividades.
