La mercancía que se introdujere o intentare introducir a la República, o se retirare o intentare retirar de la República, por cualquiera de los medios dichos en el artículo 371, quedará sujeta a secuestro; pero si tal mercancía ya hubiere sido consumida o destruída, o por cualquier otra razón no se la pudiere secuestrar, la persona o personas comprometidas en la introducción o el retiro fraudulento, según queda determinado en el artículo 371, incurrirán en una multa igual al valor de la mercancía.
