Son también de la competencia de la jurisdicción militar, con aplicación a las disposiciones ordinarias, los delitos comunes cometidos por individuos militares en tiempo de guerra, desde que comienza el servicio de campaña en el lugar donde dichos militares se encuentren; a menos que el Comando Superior ponga a los reos a disposición de los Jueces civiles.
