El comerciante que haya abandonado sin justa causa sus negocios o incumplido total o parcialmente el concordato preventivo, si estos hechos han influido en la declaración de quiebra, estará sujeto a la pena de dos a seis años de prisión. En la misma pena incurrirá el comerciante declarado en quiebra que después de la cesación de pagos, haya concedido ventajas indebidas a sus acreedores.
