Con las solicitudes que se presenten sobre adjudicación de tierras baldías deberán comprobarse, además de lo exigido hasta hoy por las leyes, que los terrenos a que se refiere la solicitud no se encuentran en los casos de expedición indicados en el artículo 1° de este Decreto. Esta comprobación deberá hacerse con las declaraciones de tres testigos y con el informe del ingeniero ó perito que haga la mensura del terreno.
