Toda persona distinta de la ejecutada, si presta la fianza de que trata el artículo 843, en la parte final del inciso tercero, puede pedir que se rescinda el secuestro, probando que tenía la posesión de la cosa l tiempo de verificarse. Esta acción se sustancia como articulación, con audiencia del ejecutado, del ejecutante y de los demás que persigan al misma cosa en juicio de prelación o prorrateo.
