El oficial de las fuerzas militares (ejército, fuerza aérea y armada, puede ser retirado del servicio activo con pase a la reserva, por decisión del gobierno, cuando la junta asesora del ministerio de guerra considere necesario adoptar tal mida en vistas de las calificaciones del oficial, o sea por mala conducta o por incapacidad técnica militar comprobadas.
