Art. 4.° De Utica á Bogotá el ferrocarril será construido por la línea que el concesionario ó quien represente sus derechos, crea más conveniente para hacer el ascenso de la cordillera, de modo que ofrezca las mayores facilidades para su construcción, respetando en todo caso las concesiones y privilegios que estén vigentes y que hubieren sido otorgados antes de la Celebración de los contratos citados en el artículo 1.º de la presente Ley. En este contrato no habrá privilegio exclusivo ni zona privilegiada en la Sabana, sino el derecho del contratista para construir el ferrocarril desde el río Magdalena hasta Bogotá.
