Cuando en el lugar no hubiere cárcel de las condiciones requeridas para tener al sindicado con las debidas seguridades, el respectivo funcionario de instrucción dará cuenta al Gobernador del Departamento, quien dispondrá la conducción del reo a la cárcel del Circuito correspondiente o del lugar más cercano donde la haya que reúna las expresadas condiciones.
